ASSUMPTION OF RISK/RELEASE OF LIABILITY
The ShopRite LPGA Classic Presented by Acer (“Tournament”), an Outlyr, LLC (“Outlyr”) owned and operated Ladies Professional Golf Association (“LPGA”) tournament reserves the right to suspend, delay, postpone, or cancel the Tournament or close the golf course for any reason. In such situations, no refunds, rain checks, exchanges or replacements will be made. This ticket is a revocable limited license, which may be revoked by Tournament at any time with or without cause at the sole and absolute discretion of Tournament and/or Outlyr.
By entering onto the grounds of the Tournament using this ticket, the holder of this ticket (and on behalf of any accompanying minor who shall also be deemed to be “holder” for all purposes herein): (1) assumes all risk incidental to the game of golf and otherwise arising out of holder's attendance at the Tournament, from known and unknown causes and conditions, including, without limitation, contracting a virus or illness, specifically including, but not limited to, COVID-19, injury from a golf shot, falls on the course and surrounding areas, and actions by other spectators, players, caddies, or others in attendance; (2) releases the LPGA, Tournament, Outlyr, host organizations, players and caddies, volunteers, Tournament sponsors, Television Broadcasters, and their respective affiliates, and all officers, directors, employees, affiliates, agents and representatives of the foregoing individuals, entities and organizations (collectively, the “Releasees”) from any and all liability (including, but not limited to, personal harm, injuries and/or illness, specifically including, but not limited to, COVID-19) resulting from attendance at the Tournament and related activities; (3) grants permission to the Tournament, the LPGA, and Outlyr to use, reproduce, stylize, digitize and alter and exploit throughout the world in perpetuity in any and all media now known or hereafter devised, without any compensation to holder, his/her name, image, voice, or other images or likenesses of the holder, including, without limitation, incidental uses in any television or other transmission of any LPGA event; (4) consents to the reasonable inspection of person, property and automobile, which may include electronic scanning and temperature screening, before entering and/or while on the grounds for safety and security purposes; (5) agrees not to seek autographs from Tournament players or caddies; and (6) agrees to abide by all policies established by the LPGA, Outlyr, and the host site, and acknowledges that a violation of any such policy can be cause for forfeiture of this ticket and removal from the Tournament. Furthermore, holder may only capture any description, video, audio, photographs, scoring-related data or statistic (“Content”) at the Tournament, consistent with all posted rules and instructions of LPGA and/or Tournament staff and solely for personal, non-commercial purposes (e.g., for holder’s personal social media accounts). Tournament is the sole owner of, and holder hereby assign to Tournament, all right, title and interest in and to all Content, including all copyrights and rights to use all Content (including rights to use holder’s social media posts incorporating the Content). Prohibited items include camera bags, weapons of any kind (regardless of permit), ladders, periscopes or selfie sticks, and noise-emitting devices. No alcoholic beverages may be brought onto or taken from the Tournament grounds. Golf stools and folding camping chairs are permitted. Any misconduct, illegal activity, intoxication, breaches of etiquette, disruptive behavior, heckling, or violation of any rule or instruction of Tournament representatives or violation of this license is prohibited and shall be grounds for forfeiture of this ticket and for holder’s removal from the premises. Tickets cannot be resold or otherwise used in a promotion or offered as a prize without written permission from Tournament. Use of any parking site provided for Tournament attendees is entirely at the risk of the vehicle driver and/or owner. Releasees are not responsible for items that are confiscated, lost or stolen. It is unlawful to reproduce this ticket.
NO REFUNDS, EXCHANGES OR RAINCHECKS. TICKET VALID ONLY FOR THE DATE INDICATED ON FACE OF THE TICKET. TOURNAMENT DATE AND TIME SUBJECT TO CHANGE. NO CAMERAS DURING OFFICIAL TOURNAMENT ROUNDS. TURN ALL CELLULAR PHONES TO SILENT. THIS TICKET IS NOT REPLACABLE IF LOST OR STOLEN. NO COOLERS. FAILURE TO OBSERVE ANY OF THE TERMS OR PROVISIONS HEREOF OR ANY TOURNAMENT POLICIES (INCLUDING, WITHOUT LIMITATION, ANY REQUIREMENT OR REQUEST TO WEAR A FACE COVERING) MAY RESULT IN THE HOLDER'S REMOVAL OR EXCLUSION FROM THE TOURNAMENT.
COVID-19 ASSUMPTION OF RISK/RELEASE OF LIABILITY
Holder acknowledges that COVID-19 is extremely contagious and that despite the measures the Tournament has implemented to help mitigate the risk of transmission, the elimination of risk of exposure and infection to COVID-19 is not currently possible. By entering onto the grounds of the Tournament using this ticket, holder acknowledges and agrees to the following for holder and on behalf of any accompanying minor (who shall also be deemed to be “holder” for purposes of the following): HOLDER ASSUMES ALL RISK AND DANGER ARISING OUT OF HOLDER’S ATTENDANCE INCLUDING, WITHOUT LIMITATION, RISKS RELATED TO COVID-19, LOSS OF HOLDER’S PERSONAL PROPERTY, INJURY, OR DEATH FROM A GOLF SHOT OR BY OTHER SPECTATORS OR PLAYERS, AND HOLDER HEREBY RELEASES THE RELEASEES FROM ANY AND ALL LIABILITIES ARISING OUT OF SUCH LOSSES, INJURIES, ILLNESS OR DEATH.
